ERS condemns Westminster seats cut

Changing political map: Wales faces constituency cut

THE ELECTORAL Reform Society have condemned a ‘dangerous U-turn’ from the Prime Minister, with news emerging that the PM is set to cut the number of MPs.

Reports had initially suggested that the PM had dropped plans to force through the cut in MPs linked with the boundary review.

However Theresa May now appears to be rejecting calls to keep the number of MPs at 650 – despite the Public Administration and Constitutional Affairs Committee warning today that moves to cut numbers to 600 are unlikely to secure the backing of MPs.

The ERS are warning that the cut in MPs actually represents a cut in backbenchers if there are no plans to cap/cut the size of the executive or ‘payroll vote’ correspondingly.

At the same time, voters will lose European representation while Parliament gains more powers after Brexit. Yet the Commons will have less capacity to scrutinise those powers. The ERS argue that places a greater burden on our democracy while posing significant risks for policy making.

ERS research in 2016 showed that in a smaller, 600-seat Commons, nearly one in four (23%) of MPs would be on the government payroll if the parties’ proportion of MPs – and the total number of ministers and whips – stayed the same – an all-time high, and up from the 21% at present (figures as of November 2016).

Darren Hughes, Chief Executive of the Electoral Reform Society, said: “Without a corresponding cap on the ‘payroll vote’, this reduction in MPs represents an undemocratic cut in the power of backbenchers to hold government to account.

“This dangerous u-turn smacks of constitutional injustice. Cutting backbenchers at the same as bolstering the executive looks to many like a worrying power-grab.

“Parliament will have a whole raft of new powers after Brexit – yet less capacity to scrutinise those powers. That places a greater burden on our institutions, while posing significant risks for policy making.

“Meanwhile it’s just common sense that this cut cannot go ahead while the House of Lords remains the second largest chamber in the world with around 800 members. If the government are concerned about reducing the cost of politics, they would do well to stay with the over-sized second chamber.

“Voters need real representation in the Commons to provide the essential scrutiny and capacity we need: both for now and when we gain new power after Brexit.

“Far from reducing political representation and weakening voters’ voices, the Prime Minister should cancel the proposed cut in MPs and move forward with fair boundaries based on a properly resourced Commons.”

After the expenses scandal in the last decade, there were calls to cut the cost of politics and one of the proposals was to reduce the size of the House of Commons. In 2011. legislation was passed to reduce the number of MPs from 650 to 600, but the review of constituency boundaries that would have made the recommendations necessary to implement these changes was halted because of disagreements within the previous Government over constitutional reform.

After last year’s General Election, Carmarthen West and South Pembrokeshire MP, Simon Hart, bemoaned the fact that reform of constituency boundaries could be a lost opportunity for reform, saying: “We need to look at the electoral system and equalise the votes between different constituencies. 110,000 voters on the Isle of Wight get one Conservative MP. 120,000 voters in three Valleys seats get three Labour MPs.”

Under the law as it still stands, a new review by the Boundary Commissions must be completed by October 2018. It must again divide the UK into 600 constituencies. Whether the UK Government is strong enough to force those changes through Parliament as it lurches daily from self-imposed disaster to another crisis is – at best – uncertain.

The Conservative Government is dependent upon the votes of the DUP to get primary legislation through the House of Commons. The coalition government, in a far stronger position, failed to get changes through due to disagreements within it on the direction and scope of constitutional reform. Last year, the DUP – which, in common with other Unionist parties, has long benefited from electoral favours from Westminster governments of both colours – asked for the boundaries proposed for Northern Ireland to be redrawn. Its unease followed analysis that revealed that the DUP would be replaced by Sinn Fein as Northern Ireland’s largest party at a General Election which followed the voting pattern of last June’s General Election.

Those fears appear to have been allayed by a not at all self-serving new boundary proposal, announced last month, which would ensure the DUP is likely to remain Northern Ireland’s largest Westminster party. Surprisingly, that concession seems to have addressed the DUP’s concerns about the future of the UK’s parliamentary democracy.

THE WALES G​REEN PARTY has rejected the opportunity to reconstitute itself as a Welsh Green Party, as opposed to a branch of the Green Party for England.

Members of the party rejected the proposal to strike it out on their own in a poll of members.

Current Green Party of Wales leader Grenville Ham was in favour of disentangling from the party in England.

Rather like other political parties –Conservatives, Labour, and Liberal Democrat – the prefix ‘Welsh’ does not denote any separate legal existence from parties England.

Scotland has a separate Green Party, but the Wales Green Party has decided against independence.

Last weekend, the Green Party of Wales held a vote to decide whether or not it should remain a regional outpost of the Green Party in England.

In a poll of the Party’s membership of 1,500 in Wales, 64.8% decided to remain attached to the current party structure.

That figure appears overwhelming, but is rather less impressive when the turnout for the vote is factored in.

Of 1,500 Green Party members in Wales, only 20% turned out to vote.

A turnout of 300 means that around 194 Green Party members held sway over around 106 of their fellow party members in a vote which 1,200 members could not even be bothered to cast a ballot.

Where this leaves the Green Party as a relevant political entity in Wales is open to question; the argument could be advanced that if 80% of its members did not care enough about the party’s identity in Wales to register a vote either for or against forming a party with a specific Welsh focus, there have to be doubts about its long term commitment to formulating policies which address specifically Welsh issues instead of goals shared with the party in England.

Critics of the vote’s outcome have suggested that its result represents a missed opportunity for the Greens in Wales to address two separate problems which have persistently bedevilled the party in recent years: firstly, the perception that the Green Party has a ‘Lady Bountiful’ attitude to Wales and the Welsh; secondly, it’s failure to make any meaningful electoral progress.

On the upside, at least the Greens held a vote.

Final programme for departure: Carwyn Jones unveils legislative aims

DEPARTING First Minister Carwyn Jones has announced the Welsh Government’s legislative programme for the Assembly’s term following the summer recess.
The programme makes good on the Welsh Government’s policy promise of ending the physical punishment of children in Wales. The measure, which has been opposed by the campaign group ‘Be Reasonable’, is one of a package of members aimed at promoting child welfare.

Commenting on the move, an NSPCC Cymru spokesperson said: “The NSPCC has long campaigned for children in Wales to have the same protection against assault as adults so the Welsh Government’s intention to remove the defence of ‘reasonable punishment’ in the coming year is hugely welcome.

“It is a common-sense move which is about fairness and equality for children.

“It is wrong that a legal defence which does not exist in a case of assault against an adult can be used to justify striking a child.

“Closing this loophole will bring Wales in line with dozens of countries around the world and finally give our children equal protection under the law.”

A bill will also be brought forward to establish duties of quality and candour in health and social care. This will place statutory obligations on all health organisations in Wales to be open and transparent and will ensure lessons are learned and improvements made where necessary. A new independent body will be created to give people a stronger voice for their experiences of health and social care services.

The government will bring forward a local government bill, which will include reform of local authority electoral arrangements, including reducing the voting age to include 16 and 17-year-olds.

The way animals are treated is an important reflection of society and over the next 12 months, a bill will be introduced to ban the use of wild animals in travelling circuses on welfare grounds.

The government will also introduce a bill to make Welsh law more accessible. The Legislation (Wales) Bill will be the first major step towards achieving a clear and well-organised statute book.

First Minister Carwyn Jones said: “The year ahead will be one of the busiest for us in legislative terms since Wales gained primary law-making powers.

“Making our statute book ready for EU exit is a big challenge for the Welsh Government and the National Assembly but we must not let this limit our ambitions. We will keep driving forward progress and delivering for the people of Wales.”

In addition to the Welsh Government’s legislative programme, the National Assembly will be asked to undertake a substantial programme of correcting regulations under the EU (Withdrawal) Act between October and March in preparation for EU exit.

However, Carwyn Jones’ final statement on the Welsh Government’s law-making priorities for the year ahead have been branded “unambitious, last-minute scribblings of a tired administration” by the Welsh Conservatives.

One of the proposals to be brought forward is a ban on wild animals from performing in travelling circuses, something Welsh Conservatives have been calling for in recent years.

Legislation to merge councils is likely to face much contention following fierce opposition from the Welsh Local Government Association over the past few months after being told they will have to merge voluntarily, or have t imposed upon them.

Interim leader of the Welsh Conservatives, Paul Davies AM, said: “After nearly 20 years at the helm, the Welsh Labour Government have been proven to be unimaginative and tired.

The headline bills to be announced today is typical Welsh Labour: tinker at the edges, but do nothing to resolve the fundamental challenges to Welsh society and its economy.

“We have an underperforming health service, a health board in special measures for three years, and an education system that ranks bottom of the UK nations.

“It is time to be more radical with public services – not only to deliver better value for money for taxpayers, but also better outcomes for everyone in all parts of Wales in health, education, and beyond.”

And Plaid Cymru’s Leanne Wood also expressed her and her party’s disappointment at Labour’s programme.

“I congratulate the First Minister on delivering his eighth and final statement on a future legislative programme.

“However, I am saddened to say this looks like a re-hash of a legislative programme we have seen before. At a time when our democracy, our nation, is in flux, we need ambition, vision and leadership. Values I do not see demonstrated by today’s statement.

“We can agree that Westminster is failing Wales. But this Parliament – the new home of Welsh democracy – was meant to give us the opportunity to do things differently. When they cancelled plans for a tidal lagoon, legislation should have been brought forward for a new nationalised Welsh energy company. We must take our future into our hands, not allow Westminster to tie them behind our back.

“We are leaving an environment that is increasingly inhospitable. Air pollution kills tens of thousands every year and plastic waste litters our coastline and countryside. But a Clean Air Act and bottle return scheme are nowhere to be seen in this statement. There is also no proposed legislation or laws to create a feminist Welsh government a reality as promised.

“Many key decisions have also been kicked into the long-grass. The size of our parliament and who can participate in our democracy, for one.

“There is not a single piece of legislation planned for education, transport, energy, the environment, housing, social care, farming and fisheries.

“This is a legislative programme of old ideas and no ambition. The Welsh Government can do better. The National Assembly can deliver better. Conservative Assembly Leader Quits

Did he fall or was he pushed?: Davies quits as Tory leader

ANDREW RT DAVIES has stood down as leader of the Welsh Conservative group in the Welsh Assembly.

Mr Davies made his announcement following a meeting of the Conservative Assembly group on Wednesday morning (June 27).

ANDREW RT DAVIES’ STATEMENT

“It is with deep regret that I announce that I have today tendered my resignation as leader of the Welsh Conservatives in the National Assembly. This was done in a letter to our Group Chairman following a meeting this morning of all group members.

“It has been a huge privilege to serve in this position since 2011, after securing the mandate of the party in a ballot of the membership. It is my firm belief that any Leader of the Assembly Group should secure the same mandate in a full ballot of the grassroots, and I hope that my successor will emerge in that manner.

“I would like to thank the Group for their support throughout my leadership, and in particular to express my gratitude to the many dedicated and professional staff I have had the privilege to work with – and for.

“I look forward to supporting whoever emerges from the contest to replace me, and I will continue to place all of my efforts into advancing the Welsh Conservative cause both here in Wales and Westminster.

“As a party we would achieve nothing without the hard work and dedication of our grassroots and I would like to thank them all for the support they have given me in Wales. Nothing could make me prouder than to have enjoyed their backing throughout this journey.

“I would like to thank the Prime Minister for her support and I wish her the very best in delivering for the country and the Conservative Party moving forward.

“And finally, thanks to my family, particularly my wife Julia who has supported me each and every step of the way.”

ANOTHER LEADERSHIP CONTEST

Although the Conservatives are the second largest party group in the Senedd, they have failed to make progress at the ballot box under Andrew RT Davies leadership, losing ground at Westminster in 2017 and failing to capitalise on a collapse in Labour’s share of the vote in the Assembly elections in 2016. It is noteworthy that he only rose to leadership of the Assembly group when good results achieved under his predecessor, Nick Bourne, meant that Mr (now Lord) Bourne lost his regional seat in the 2011 elections.

Mr Davies’ departure means that there is likely to be a contest for the leadership of each of the main Assembly parties over the coming months. Carwyn Jones is due to step down in the autumn, while Plaid Cymru leader Leanne Wood faces a potential challenge from Adam Price and/or Rhun ap Iorwerth.

Paul Davies, the Preseli Pembrokeshire AM, will be interim leader of the Assembly group and is a likely candidate for the permanent job. The narrowness of the field, previous contender Nick Ramsay has ruled himself out of the running, suggests few challengers to Paul Davies in the event he wants the job.

In a parting shot, the departing leader made it clear that he wanted a grassroots election and not a coronation by the Assembly Group.
Although Andrew RT Davies had repeatedly indicated a willingness to work with other parties to oust Labour from Government, there were no takers among other Assembly parties. In a speech at Ffos Las in May, he offered to stand aside if another candidate came forward who could unite the Assembly’s opposition parties against Labour.

CLASHES WITH WESTMINSTER

Mr Davies’ willingness to embrace Mark Reckless’ return to the Conservative fold as a member of the Assembly group caused friction both between him and both the Westminster Conservatives and his Assembly colleagues. Party activists were also unimpressed, bearing in mind Mr Reckless’ resignation as a Conservative MP in 2014 – which was carefully timed to cause maximum embarrassment to then-Tory leader David Cameron.

Shortly after his leader’s resignation, Mark Reckless tweeted that Mr Davies had been ‘pushed out’ by remainers in the Conservative Assembly group.

Andrew RT Davies had also recently been heavily criticised, both in public and in private about his statement that Airbus’ warning on its Welsh operations were ‘scaremongering’. And while his remarks might have been otherwise unremarkable, the fervid and foetid atmosphere in the Conservative party over the Brexit issue meant they struck precisely the wrong note with AMs trying to ensure that the Conservatives in Wales are seen as responsive to the needs of Welsh businesses over the shape of any eventual Brexit deal.

Mr Davies’ spiky relationship with Westminster Conservatives was also thrown into sharp relief by a very public slap down delivered by Guto Bebb, Minister of Defence Procurement following comments regarding Airbus.

Mr Bebb pointedly said that Mr Davies was not the leader of the Conservatives in Wales and called for him to retract his ‘inflammatory comments, continuing: “Shooting the messenger is an unworthy position for a politician to take not least when that politician aspires to lead a government in Wales.”

A row between Mr Davies and Welsh Secretary Alun Cairns led to neither appearing in a televised debate during last year’s General Election, with Darren Millar AM appearing instead.

Although Mr Davies has been constant and consistent in his support for the Swansea Bay Tidal Lagoon, he was left high and dry by his Westminster colleagues’ decision on the issue. The failure of the UK Government to support the Swansea Bay Tidal Lagoon project ate into Mr Davies’ political capital as capable of exercising even minimal influence over the way the UK Government treats Wales.

That problem was compounded by the increasing sense among the Welsh public that the UK Government has placed the demands of a dozen DUP MPs in Westminster over the interests of Wales.

TRIBUTES LED BY FIRST MINISTER

On Wednesday there was the usual round of warm tributes from Mr Davies’ political opponents.

Outgoing First Minister Carwyn Jones said: “Despite our obvious political differences, I always found Andrew to be good company, and he never broke the confidences I shared with him as Leader of the Opposition. That is the sign of a decent and honest politician.

“Andrew has made his mark in Welsh politics and his jovial and larger than life personality has always been a breath of fresh air during Assembly proceedings. I wish him well in the future.”

The Welsh Liberal Democrats thanked Andrew RT Davies for his contribution to Welsh politics and wished him the best for the future.

Welsh Liberal Democrat Leader Jane Dodds commented: “I’d like to thank Andrew RT Davies for the contribution to Welsh politics he’s made as Leader of the Welsh Conservatives since 2011. I wish Andrew the best as he returns to the backbenches and hope he enjoys having a little more time to spend with family and friends.

“Whilst we disagree on many issues like Brexit, any leader who puts their time and energy into trying to make Wales a better place deserves respect. I’m sure Andrew will now put all that time and energy into representing his constituents.”

UKIP’s Neil Hamilton mourned the loss of a fellow staunch Brexiteer: “I am sorry that Andrew RT Davies resigned this morning as Leader of the Welsh Conservatives. Andrew is a combative Brexiteer in a Tory group which is dominated by Remainers.”

Mr Hamilton then turned his attention to the fate of employees of the Conservative group in the Assembly, whose futures he called into question: “Andrew RT is not the only one out of a job. According to the Assembly Commission, the Tory group staff are all now out of a job too, as their contracts automatically end without notice when a group leader resigns.

“This was the Commission’s argument before the Employment Tribunal last week to justify Caroline Jones’ sudden dismissal of UKIP’s former Chief of Staff, Robin Hunter-Clarke, after she became UKIP Group Leader. They argued in court that the contracts were personal to the group leader in whose name the contracts were signed.

“I challenge the Assembly Commission to justify publicly their disgraceful policy of deliberately depriving political group staff of their job security and employment protection rights.”

Llywydd Elin Jones, said: “We come from different political traditions, but you have served your party with energy and integrity. I now look forward to a lively contribution from the backbenches!”
